SANTA CLARA, Calif. — The Ohio owners of a theme park adjacent to a proposed stadium for the 49ers in Santa Clara, Calif., are suing the city, saying an agreement with the team is illegal.

The lawsuit filed Monday by Cedar Fair Entertainment, the Sandusky company which owns the Great America Theme Park, says the city should have approved an environmental impact report for the stadium before reaching an agreement with the team in June.

The nonbinding terms include $114 million in public funding.

City Manager Jennifer Sparacino says the city is hopeful it can resolve its differences with Cedar Fair.

Meanwhile, the City Council on Tuesday approved the environmental report and directed staff to draft a ballot measure to gain voter support for the project.
