DOH files complaint against paint company

The State Department of Health has filed a complaint and order against Shinco Management Inc. for alleged violations of the state's hazardous waste statues.

The DOH said in a news release this morning that the painting company was cited on two counts: 1) For failing to make a hazardous waste determination; and 2) for the treatment and disposal of hazardous waste without having a permit.

The alleged violations were observed during an inspection in August, 2006. Paints and thinners were brought back to the company's facility and rags were used to absorb and dry out the paints and thinners so they could be disposed of in the landfill.

Paints and thinners are usually considered hazardous waste when they are disposed.

Shinco faces a $32,500 penalty. In addtion, the company has been ordered to comply with state hazardous waste rules for the cited violations.

Shinco has 20 days to contest the order. If it does, the case will be set for a contested hearing.
